NSW CTP legislation:
where to start.
The accident date matters. Use this overview to find the right official information, not to determine your own entitlements.
Start with the date of the accident
The Motor Accident Injuries Act 2017 establishes the scheme for motor accidents on or after 1 December 2017. The Motor Accidents Compensation Act 1999 relates to the earlier scheme for accidents from 5 October 1999 to 30 November 2017. Earlier accidents may involve the Motor Accidents Act 1988.
What does this mean for psychology?
Treatment, assessment for a clinical question, a treating-practitioner report and independent expert evidence are not interchangeable services. Be clear about the purpose of the referral before arranging the appointment.
Ask your insurer what treatment is covered and what authorisation is needed. Your psychologist can discuss clinical goals and the information needed to support a treatment request. They do not make the insurer's funding decision.
Use the current official source
Legislation and guidelines can be amended. An old PDF or another person's claim experience may not describe the current requirements for your circumstances. Follow the official links below and check the version information before relying on them.
Questions worth taking to your insurer
- Which scheme applies to this claim?
- What assessment or treatment can be arranged now?
- Is written authorisation needed for this psychologist and service?
- What is the process if more treatment is recommended?
- Who can explain a decision or a review option?
Seek advice promptly about a disputed decision or time limit. This guide does not give legal advice or calculate deadlines.
